Terms of Use
Effective date: Pending review: to be confirmed
André Murphy is an individual sole proprietor based in California who operates this bookstore under the publishing brand Ash & Echo Press. Ash & Echo Press is a brand name, not a separate legal entity. In these Terms, “we,” “us,” and “our” refer to André Murphy. Contact: ash.echo.press@gmail.com.
These Terms govern your use of this website, customer accounts, and digital books purchased here. By using the site or making a purchase, you agree to these Terms.
Purchases are sold through Link using Stripe Managed Payments. Link is the merchant of record for these transactions and provides payment receipts and transaction-related support. André Murphy provides the ebooks, My Library delivery, and product support through Ash & Echo Press.
1. Eligibility
You must be at least 18 years old to create an account or make a purchase. Purchases are currently available only to customers with a United States billing address. If an order is placed with a non-U.S. billing address, we may cancel it, refund the payment in full, and not deliver the book.
2. Accounts
You are responsible for keeping your login secure and for activity under your account. Provide accurate information, and do not share your account. We may suspend or close accounts used for fraud, abuse, or violations of these Terms.
3. Digital books and your license
André Murphy supplies and licenses the ebooks through Ash & Echo Press, subject to the rights of the books’ copyright owners.
When you complete a purchase, you receive a personal, non-exclusive, nontransferable license to use the digital edition for your own personal, non-commercial use. Under this license you may:
- download the file to and read it on your own personal devices; and
- print one copy for your personal use.
Unless applicable law permits it, you may not resell, share, distribute, upload, transfer, sublicense, or publicly display the file or any printed copy, or remove copyright notices. All copyright and other rights in the books remain with their owners. Pending review: California digital-goods license disclosure
4. Delivery and My Library
Digital editions are delivered as downloadable PDF files. No physical book is shipped. After a successful purchase, the book appears in My Library. You can request a new secure download link there while your purchase remains active. Blocked or cancelled orders do not provide online library access.
When an order is fully refunded or reversed, online My Library access for that order ends and new download links are no longer available. Copies you legitimately downloaded may be kept and used under the personal-use license in Section 3 of these Terms. Online library access is separate from those downloaded copies.
If we ever discontinue My Library or a title, we will try to give reasonable advance notice by email so you can download your books first, unless this is not possible for legal or technical reasons. We recommend keeping a personal backup of your downloads.
5. Prices, taxes, and payment
Prices are shown in U.S. dollars before tax. Applicable sales tax is calculated and added at checkout based on your billing address. Payments are processed by Stripe. We may correct obvious pricing errors and may cancel affected orders with a full refund.
6. Refunds
Refunds are covered by our Digital Purchase & Refund Policy, which is part of these Terms.
7. Acceptable use
Do not misuse the site: no unauthorized access, interfering with its operation, scraping or bulk downloading, circumventing download protections, or using it for unlawful purposes.
8. Disclaimers
The site and books are provided "as is" to the extent permitted by law. Our books are for general informational and personal-development purposes. They are not professional, psychological, medical, or legal advice. Nothing in these Terms limits rights you have under consumer-protection laws that cannot be waived. Pending review: consumer-rights wording
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to a purchase is limited to the amount you paid for it. Pending review: liability wording
10. Governing law
These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules. This does not take away protections you have under the consumer laws of the state where you live. Pending review: venue and dispute resolution
11. Changes
We may update these Terms. We will post updates on this page with a new effective date. Changes do not apply to purchases completed before they take effect.
